Minor Emancipation New Jersey?
I am almost 16 years old. The stress that my house causes me is unbearable. I can already tell you that it is not what you think. Most teenagers hate their households because their curfew is too short, or they can’t sleepover a guy’s house; this is not what I have to deal with. The things I have to go through at this house are ridiculous, and I can no longer live here. Please help me by telling me what I can do. I live with guardians, my dad is in jail, my mother died. There has to be a way I can live somewhere else. I am willing to wait until I am sixteen or seventeen until I move out, but all I know is that the past three years living here has been hell. Please tell me what I can do to leave this house and possibly move somewhere else, I would rather not stay at a friends house. I live in New Jersey, so please tell me the laws of minor emancipation. Is there a possibility that I could move into an apartment? thanks.
You can be emancipated with a court order IF you:
1. Can financially support yourself. That means rent, health insurance, food, electric etc etc. You will need about 1500-2000 / month for that.
2. I presume you are getting survivors benefits from the death of your mom. Those monies will stop the instant you are emancipated.
3. You need good cause. You don’t detail what exactly is so ridiculous about your living situation, so I can’t say if you have it or not.
4. You must be enrolled in school (whilst earning your @2K month)
I am guessing that your guardians were appointed by your father upon the death of your mother, or when you father was incarcerated. If you are a ward of the state instead, and living with state approved people, then you need to tell your worker what is going on.
It is very very rare to get emancipated. Very very rare.
